Reminder: Fireworks not allowed within Spearfish City Limits

SPEARFISH, SD – Across the nation, Americans will observe Independence Day over the upcoming holiday weekend, albeit with various activities postponed or limited due to the current COVID-19 pandemic. The City of Spearfish encourages residents to celebrate and practice safety during all Fourth of July activities – and reminds everyone that fireworks are not allowed within City Limits.

“Independence Day is a time to celebrate, and we hope everyone has a safe and enjoyable holiday weekend,” Public Safety Director Pat Rotert said. “With the dry conditions this year, we urge people not to shoot off fireworks even in areas where they are allowed, and we remind everyone that within Spearfish City Limits, fireworks are not allowed. Do not shoot off fireworks of any kind in City Limits.”

Spearfish City Ordinance Section 7-3, “Sale or discharge of fireworks,” states, “No person may sell or caused to be sold, discharge or caused to be discharged, any pyrotechnics or fireworks of any description whatsoever within the city. Exception: the discharge of fireworks as part of a professional display operated by a licensed pyrotechnic operator under the procedure set forth in the International Fire Code, as adopted from time to time.”

There are no professional displays taking place in Spearfish this year. In the area, the professional firework displays at the Black Hills Roundup in Belle Fourche are still occurring, and the display over Lead’s Open Cut has been postponed until Labor Day. Those wishing to set off fireworks outside of Spearfish City Limits should be aware of the dry conditions and take necessary precautions. They must also be aware of restrictions: South Dakota Codified Law 34-37-11 states that no fireworks are allowed within the boundary, or within 300 feet of the boundary, of the Black Hills Fire Protection District, nor within any public lands, including national forest, national park, state forest, or any land owned or leased by South Dakota Game, Fish, and Parks. “We know there are various traditions during the Fourth of July holiday, from getting together with friends and family to enjoy a barbecue to taking part in the annual Independence Day parade down Main Street,” Rotert said. “This year, especially, though, we must consider the wellbeing of our friends and neighbors. Please stay home if you are ill, and if you are in the higher-risk categories for COVID-19 (older adults and others at increased risk of severe illness), please consider avoiding large gatherings. If you attend, consider social distancing and wearing a face mask, per CDC (Centers for Disease Control and Prevention) guidance.”

In observance of the Independence Day holiday, Spearfish City Hall and all City offices will be closed Friday, July 3. Grace Balloch Memorial Library will be closed July 3, 4, and 5.
